Terms and Conditions of Service for Commissions


If you have a problem with any of these terms, they may be changed if discussed with me prior to paying for your commissioned piece.

1. GENERAL TERMS 

  • The commission doesn’t start until both parties have signed, understood, and agreed on the “Art Commission Contract Agreement” and the client has paid for the non-refundable 100% or 50% initial deposit to the Artist.

  • The Art Commission Contract Agreement is a detailed and personalized contract created by the Artist and sent to the client once both parties have agreed to the artwork requirements and all costs to the commission as a final confirmation to start the commission process.

  • The Artist will not start or work on the commission if the client does not sign and accept the contract. 

  • All artworks, illustrations, and designs will include a signature that you may not remove whatsoever. 

  • I can record and exhibit the creation process of the commission [artwork, illustration, and designs] and post it on any of my social media accounts. 

  • Prices are subject to change at any time and based on demand. 

  • I reserve the right to reject any order for any reason.

  • Do not alter, edit or remove my watermark and signature on the finished artwork.

  • You must credit me at all times, which includes but not limited to, when you post the artwork anywhere in the internet and social media.

  • I reserve the right to reject any order for any reason.

  • If you are looking to get full copyrights, licensing, and use my work commercially, I will ONLY agree to a contract with royalties + initial down payment.

2. PAYMENT 

  • All currency accepted is USD (US Dollars.) 

  • I accept payment through PayPal, Venmo, US bank transfer, and Most Credit/Debit Cards. 

  • Commissions can be paid either 100% upfront or a split 50% upfront and the rest of the 50% can be paid after the commission is finalized and done. The final artwork without a watermark won’t be delivered to the client until this final 50% is paid and proceed. However, if I am shipping the final artwork to the client, the client has to make the full payment first, before the Artist sends the actual artwork to the client. 

  • An non refundable and initial deposit of 100% or 50% of the total price or fee for the commissioned artwork shall be due within 5 business days after the contract is signed and the invoice is sent to the Client. The Artist will start the work once this initial deposit payment is processed/paid.  Please be aware that all initial deposits are non-refundable. 

  • If the initial deposit payment is not made within the 5 business days then this contract will be automatically terminated and the Client will have to request for a new Agreement Contract for the Work they requested. 

  • Upon the Client’s final inspection and acceptance of the artwork, the remaining balance shall be due within 5 business days. Past-due final payments shall incur a (10%) interest penalty each week the balance is past due. If the Artist must take legal action to acquire final payment, the Client shall be responsible to pay for all of the Artist’s legal fees with no exceptions.

  • After the final payment is processed and paid, the artist will send a file or ship the artwork to the client with tracking information.

  • Don't send me any payment before I have agreed to give you a slot and requested you to send me the payment. 

3. PROCESS AND DELIVERY 

Digital Art & Graphic Design:

If I accept your commission, I will email you a project guideline, invoice of the price estimate of your commission, art commission contract agreement, and the next steps. Once the non-refundable 100% or 50% initial deposit payment is processed, I will start the commission.

  • I will notify you when I have started on your commission and you, therefore, lose the rights to a refund unless I have decided to cancel the commission due to personal circumstances. 

  • While I'm working on your commission I will send you WIPs routinely through email and make frequent reviews with you through the project guidelines to make sure I make it just right for you! 

  • During the reviews, you will see work-in-progress and these images will usually include a watermark and be smaller than the finished piece. 

  • Estimated Timeline: 1 week to 3 months this depends on what the client is asking for and my personal schedule.

  • If anything comes up that will slow the progress of the initially estimated delivery time I will let you know asap. 

  • Once the piece is finished you will receive the full-resolution png image along with a web-friendly size. Note that there is no physical product provided.

Traditional Art & Physical 3D:

If I accept your commission, I will email you a project guideline, invoice of the price estimate of your commission, art commission contract agreement, and the next steps. Once the non-refundable 100% or 50% initial deposit payment is processed, I will start the commission.

  • I will notify you when I have started on your commission and you, therefore, lose the rights to a refund unless I have decided to cancel the commission due to personal circumstances. 

  • While I'm working on your commission I will send you WIPs routinely through email and make frequent reviews with you through the project guidelines to make sure I make it just right for you! 

  • During the reviews, you will see work-in-progress and these images will usually include a watermark and be smaller than the finished piece. 

  • Estimated Timeline: 1 week to 6 months this depends on what the client is asking for and my personal schedule.

  • If anything comes up that will slow the progress of the initially estimated delivery time I will let you know asap. 

  • Client can choose the following options for the traditional artwork delivery: 

    Final Artwork Not Shipped:

  • Once the piece is finished you will receive the scanned high resolution png image along with a web-friendly size color corrected to the actual artwork. Note that there is no physical product.

    Final Artwork Shipped:

  • Once the piece is finished you will receive a HD resolution image of the scan copy of your commissioned traditional artwork and shipped physical product.

  • To receive the physical artwork extra shipping price will be charged on the invoice for the client.

    • All shipments will include tracking, insurance, and signature confirmation

  • The final artwork will not be shipped until the Client has made full payment.

Digital 3D:

  • During the reviews, you will see work-in-progress and these images will usually include a watermark and be smaller than the finished piece. 

  • Estimated Timeline: 1 week to 6 months this depends on what the client is asking for and my personal schedule.

  • If anything comes up that will slow the progress of the initially estimated delivery time I will let you know asap. 

  • Once the piece is finished you will receive the sketchup or blender file and/or full-resolution image along with a web-friendly size. Note that there is no physical product provided.

4. REVISIONS 

  • You get 3 rounds of changes on the commissioned piece included in the price. 

  • You can’t use your revision during the final finishing stage of the piece and if you do that will be additional 30% charge.

5. KILL FEE

  • If Client decides to terminate this Agreement prior receiving the artwork, Client will compensate Artist as follows: 

    • If the Work has been partially completed or started, the Client will not get any refund of initial deposit payment. Client will not be entitled to receive the Work, and all intellectual property rights shall remain with the Artist.

    • If the Work has been completed, the Client will pay the Artist the total Fees as listed in this Agreement. Client will be entitled to receive the Work, and all intellectual property rights therein, if Client chooses. 

6. COPYRIGHT, NON- COMMERCIAL/PERSONAL USAGE POLICY

I, CJKKJH [Catheryn Kim] (the artist), claim the rights to the produced artwork, not the client. Therefore, I am allowed to use the copyrighted artwork to:  

  • Promote myself with it everywhere I want (includes, but not limited to Instagram, Facebook, Twitter, Tik Tok, Pinterest, Youtube.)

  • Publish books with it (artbooks, etc.) 

  • Make commercial profit off the commission

  • Display it everywhere to my liking (website, social media, etc.) 

  • Post it wherever and whenever I want.

The client is allowed to: 

  • Use the commissioned piece for personal use unless agreed otherwise (you can upload it on all your social media profiles, forums, etc.) 

  • Print the artwork and claim the character(s) as their own, but not the artwork itself.

  • Do not claim the artwork as your own. Must put credit.

  • You are not allowed to add your own watermark to the artwork. If you post it, post the one that has my watermark on it.

The following is considered copyright infringement: 

  • Commercially making any type of profit off the commissioned piece.

  • Reproducing/using the copyrighted artwork commercially - which means making money off it in any way. 

  • Claiming the artwork as your own

  • No credit to the artist

  • Removing my signature from the artwork 

  • Altering the artwork without my consent 

  • The client can’t reproduce, alter, claim, distribute, use for non-personal use, commercialize off the commission work without the Artist's explicit written consent.

  • I reserve the full rights to the image and its use/distribution unless otherwise agreed upon (rights to the image for your own non-personal use may be purchased at any time).

  • If a client is looking to get full copyrights, licensing, and use my work commercially, please ask me for detailed information and pricing. If this is the case, please understand that I will ONLY agree to contract with royalties + initial down payment only.

7. CUSTOMER SATISFACTION 

  • I will do everything I can to the best of my ability to make my client happy! 

  • If you have a problem with anything in regards to the commissioned piece please tell me right away so we can find a solution together. 

  • I am willing to change some of my terms for you if you ask before I start on your commission. If you, e.g., do not want me to post your art anywhere, we can discuss this in further details via email.

8. REFUND / CANCELLATION POLICY 

  • The client is not allowed any type of refund, once I start working on the commission. 

  • If for any reason I am unable to start your commission you will receive a full refund. 

  • I don’t accept any cancellations.

  • No cancellations in the midst of progress.

  • If you are getting a refund, do not request any type of chargeback. I will transfer the money back to you myself. 

  • If you request any type of chargeback at any point when you were not allowed to ask for a refund, you will lose all before mentioned rights to the commissioned piece and I will have the full right to profit from the commission further from it in any way I want. I will decline the chargeback and supply the merchant service, Paypal, or whatever payment service with our contract details, conversations via email in which we talk about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted for commissioning me again.

9. NON EXCLUSIVITY, NO EMPLOYMENT OR AGENCY

  • Neither party is, by virtue of this Agreement, authorized as an agent, employee, or legal representative of the other. Except as specifically set forth herein, neither party shall have the power to control the activities and operations of the other, and its status at all times will continue to be that of an independent contractor relationship. 

  • The Parties acknowledge that this Agreement is non-exclusive and that either Party will be free, during and after the Term , to engage or contract with third parties for the provision of services similar to the Services. Client and Artist hereby acknowledge and agree that nothing contained herein is to establish an exclusive relationship between the Parties. The Artist shall be free to continue working for and taking on new clients, without regard to Client. Artists do not need Client approval for any such work.

If the client breaks any of the points stated above they will lose all the before mentioned rights to the artwork commissioned by me, CJKKJH [Catheryn Kim] (the artist), and I will have the right to profit further from the commissioned artwork in any way I see fit. If you have a problem with any of these statements, they may be changed if discussed with me prior to paying your commissioned piece.

Please be aware that all Terms and Conditions of Service are subjected to change at any time.
